2. Service Description
2.1 TradingAPI provides a suite of tools and services for technical analysis, including a free plan limited to 1000 API calls per day, a Business plan with advanced features, and an advanced dashboard for algorithmic trading.
2.2 TradingAPI strives to provide accurate and reliable data but does not guarantee the completeness, accuracy, or timeliness of the information provided.
2.3 TradingAPI has launched TradingAPIRestBot on Telegram, which allows users to receive technical analysis insights for specific cryptocurrencies or tokens within a Telegram group. Group administrators can configure the bot by specifying exchanges, trading pairs, and symbols of interest.
3. Payments
3.1 TradingAPI uses USDT and Stripe, as a means of processing payments and subscriptions on the TradingAPI.rest platform.
3.2 Users can opt for a lifetime access option by paying for the 'Lifetime Subscription Plan - v1'. This provides unlimited access to TradingAPI's v1 functions and premium features like AI, API.
3.4 It is the user’s responsibility to ensure that their API Keys are safe.
4. User Responsibilities
4.1 By using TradingAPI’s services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
4.2 You agree to use TradingAPI’s services in compliance with all applicable laws and regulations. You shall not use our services for any illegal, fraudulent, or unauthorized purposes.
4.3 You are responsible for maintaining the confidentiality of your API keys and account credentials. Any activities conducted through your account will be deemed to have been authorized by you.
5. Intellectual Property
5.1 TradingAPI retains all rights, title, and interest in and to its services, including all intellectual property rights. You acknowledge that you do not acquire any ownership rights by using our services.
5.2 You agree not to copy, modify, distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from TradingAPI without our prior written consent.
6. Data Usage and Limitations
6.1 Subscribers to free plans (including the free subscription plan) may only use TradingAPI data for personal and non-commercial purposes. Reselling or offering TradingAPI data to your own customers or any third party is strictly prohibited without a Lifetime Plan Subscription.
6.2 Users are not permitted to exceed the API call limits associated with their chosen plan. TradingAPI reserves the right to throttle or suspend access to the API if usage limits are exceeded.
7. Disclaimer of Warranties
7.1 TradingAPI’s services are provided on an “as is” and “as available” basis, without any warranties of any kind, whether express or implied.
7.2 TradingAPI does not warrant that its services will be uninterrupted, error-free, or free from other harmful components.
7.3 TradingAPI shall not be liable for any trading losses, lost profits, or any other indirect, incidental, or consequential damages arising from the use of its services.
8. Limitation of Liability
8.1 To the maximum extent permitted by law, TradingAPI shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of its services.
8.2 In no event shall TradingAPI’s aggregate liability exceed the total amount paid by the user for the specific service at issue during the 12 months preceding the event giving rise to the claim.
8.3 TradingAPI shall not be liable for any delays, interruptions, or failures in performance resulting from acts of God, natural disasters, civil disturbances, or other causes beyond its reasonable control.
9. Indemnification
9.1 You agree to indemnify, defend, and hold harmless TradingAPI, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses arising out of your use of our services, including but not limited to any malfunction, modification, or revocation of access to the API, or your violation of these Terms.
10. Termination
10.1 TradingAPI reserves the right to terminate or suspend your access to its services at any time, without notice, for any reason, including but not limited to breach of these Terms, unauthorized use of API keys, or engaging in fraudulent or illegal activities.
11. Governing Law and Jurisdiction
11.1 These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.
11.2 Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Bari, Italy.
12. Severability
12.1 If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
13. Donations
13.1 Donations to TradingAPI are 100% non refundable
14. Entire Agreement
14.1 These Terms constitute the entire agreement between you and TradingAPI regarding the use of our services and supersede any prior agreements or understandings, whether written or oral.
By using TradingAPI’s services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, please discontinue your use of our services immediately.
